On May 29, the U.S. Supreme Court released its Seven County Infrastructure Coalition v. Eagle County, Colorado decision, holding that substantial judicial deference to agency decisions is required in National Environmental Policy Act (NEPA) cases, including when determining the scope of environmental effects addressed in environmental impact statements (EIS). The majority opinion clarifies that “courts should defer to agencies’ decisions about where to draw the line [on EIS scope]—including (i) how far to go in considering indirect environmental effects from the project at hand and (ii) whether to analyze environmental effects from other projects separate in time or place from the project at hand.” This decision narrows the scope of NEPA review and will likely have lasting impacts on federal infrastructure project proposals.

The panel will consider questions raised by the decision and discuss what the case will mean for federal environmental law moving forward.
